Does using a labour hire provider move compliance risk away from my business?
No, not entirely. Under the model WHS laws, both the labour hire provider and the host business owe safety duties to the worker and neither can contract them out. In licensing states, using an unlicensed provider is an offence for the host. Same job, same pay orders are triggered by the host's enterprise agreement.
